Agenda Item: 8g_attach1 Meeting Date: July 8, 2025 MEMORANDUM OF UNDERSTANDING by and between PORT OF SEATTLE And SEATTLE/KING COUNTY BUILDING & CONSTRUCTION TRADES COUNCIL, AFL-CIO, And WESTERN STATES REGIONAL COUNCIL OF CARPENTERS Re: Substance Abuse This Memorandum of Understanding (MOU), made effective as of the date of signing, is entered into by and between the SEATTLE/KING COUNTY BUILDING & CONSTRUCTION TRADES COUNCIL, AFL-CIO, And the NORTHWEST CONSTRUCTION ALLIANCE II (Unions) and the Port of Seattle (Port), referred to herein as the Parties. WHEREAS, the Parties executed a Project Labor Agreement ("PLA I") effective December 1, 2018, for projects commencing after that date and extended to cover projects commencing through October 31, 2024. In that PLA, the parties agreed to allow amendments or modifications by mutual agreement. BY MUTUAL AGREEMENT THE PARTIES AGREE TO THE FOLLOWING: WHEREAS, PLA I contains a Substance Abuse Program that is administered by the Port's Substance Abuse Program Administrator with oversight by the Port's Substance Abuse Coordinator; WHEREAS, the subsequent PLA ("PLA II") covering projects that commenced on or after January 1, 2025, has a substance abuse program that is administered by the signatory contractors; WHEREAS, the parties agree that for projects covered by PLA I and subsequent extension, which commenced between December 1, 2018, and October 31, 2024, and that remain ongoing as of the date of this Memorandum: 1. Appendix A to PLA I is hereby removed as well as Article 15; 2. As PLA I will now be silent on the issue, drug testing may be performed in accordance with the applicable Master Labor Agreements; 3. To the extent consistent with Section 2, above, or as required by state and federal law, the Port may elect to address drug testing in its contract documents with contractors working on projects identified above and ongoing under PLA I. 1 of 2 _____________________________________ Stephen P.
