Re: LETTER OF RECOMMENDATION FOR INTERLOCAL AGREEMENT COMPLETION

Authority: Section 2.3 of the 2018 Interlocal Agreement

This Letter of Recommendation (LOR) is entered into by the City of SeaTac City Manager and

Port of Seattle Airport Managing Director in order to comply with the provisions of the Port of

Seattle/City of SeaTac Interlocal Agreement (ILA), which became effective February 18, 2018.

Section 2.3 of the ILA specifies the procedure, in the fifth year of the ILA, for recommendation

to the Joint Advisory Committee (JAC) whether to “complete the term without renegotiating

the terms of the provisions of the Agreement or reopen negotiations immediately.”

Items to note in support of our recommendation include:

• In the five years that the ILA has been in effect, only ten (10) Letters of Agreement

(minor amendments) have been adopted between the parties. The last minor

amendment was adopted in 2021.

• In the five years that the ILA has been in effect, the JAC has met on a regular basis to

review how the ILA is operating. No concern has been raised.

• In the five years that the ILA has been in effect, SeaTac and Port staff have met on a

regular basis to review how the ILA is operating, to exchange information and identify

any recommended changes or potential amendments to the ILA.

• In the five years that the ILA has been in effect, regular monthly check-ins have been

held between SeaTac and Port staff to foster the relationship and ensure compliance

with Section 2.2 (No Surprises) and Section 2.1 (Good Faith).

• In the five years that the ILA has been in effect, SeaTac and Port staff have worked

collaboratively and effectively on projects, events, and incidents regarding land use,

transportation, permitting, environmental, and public safety issues.

By virtue of our signatures below, both the City and Port staff recommend completion of the

term of the ILA pursuant to ILA Section 2.3 without renegotiation.
