Request Commission authorization for the Executive Director to execute an amendment to the
interlocal agreement with the Northwest Seaport Alliance (NWSA) for the Support Service
Agreements between the Port of Seattle and the NWSA to clarify that each party has authority
to obtain services from outside sources.
EXECUTIVE SUMMARY
The Port and the NWSA provide services to each other via an interlocal agreement that is
approved each year. The Commission approved the latest interlocal agreement on November
14, 2017. The language of the interlocal agreement is not clear that the parties are free to
obtain those services from sources other than each other. This amendment clarifies this issue.
DETAILS
The proposed amendment to the interlocal agreement would add a sentence to section I.B. of
the agreement: “The NWSA and POS, in their respective sole discretion, may obtain the
services under this Agreement from entities other than the Parties to this Agreement.”
