Labor Practices for Projects Located on Port of Seattle Property and Priority Hire
ACTION REQUESTED
Request adoption of Resolution No. 3746: a resolution of the Port of Seattle Commission
amending the Policy Directives on Construction Labor Practices for Projects Located on Port of
Seattle Property and Priority Hire created by Resolutions 3725 and 3736, respectively, to
change the threshold for applying project labor agreements to Port projects and related
definitions.
EXECUTIVE SUMMARY
The amendments contained in Resolution 3746 change the dollar threshold for the assumption
in favor of Project Labor Agreements in the Port’s Construction Labor Policy and the definitions
in the Port’s Priority Hire policy.
JUSTIFICATION
The Port of Seattle Commission approved Resolution 3725 on October 25, 2016. The resolution
was drafted by the Commission’s Projects and Procurement Committee, chaired by
Commissioners Albro and Creighton, along with external advisors from labor, small businesses,
general contractors, and minority advocacy groups.
The change proposed in these amendments will adjust the threshold for an assumption in favor
of a Project Labor Agreement from $5 million in labor costs to a contract that exceeds $5
million. The rationale for the change is that the City of Seattle and King County both have or will
have a similar $5 million contract level, creating further regional alignment. The City, County
and Port have been working closely on engagement for increasing the labor pool available for
our large projects through priority hire. The more the Port and regional partners can use similar
terms and approaches to projects in the region the easier it is to accomplish our priority hire
and Project Labor Agreement objectives. This also provides more clarity for the Port,
contractors and labor when the Port evaluates the applicability of a Project Labor Agreement to
a project.
