RESOLUTION NO. 3615
A RESOLUTION of the Port Commission of the Port of Seattle authorizing
the Chief Executive Officer to enter into Agreements with the
City of Seattle for implementation of Duwamish ITS Phase 3
and Kent for construction of grade separations in the South
228
th
Corridor; and approving a total Port of Seattle
contribution of $1,700,000 plus staff and consulting resources.
WHEREAS, Port of Seattle has joined with other agencies and private partners in the
Freight Action Strategy for Seattle and Tacoma (FAST) Corridor partnership; and
WHEREAS, some of these partners have agreed to make intelligent transportation
system (ITS) improvements in the Duwamish and SODO areas of Seattle, to benefit the
movement of freight and goods and enhance the use of other Port related facilities; and
WHEREAS, some of these partners have agreed to construct grade separations of
BNSF Railway and UP rail lines at South 228
th
Street in Kent, eliminating the at-grade
railroad crossings to reduce delay and improve truck access to warehousing and distribution
centers in the Kent Valley; and
WHEREAS, the Port entered into a “FAST Corridor Phase 2” Memorandum of
Understanding on January 28
th
of 2003;
WHEREAS, the City of Seattle is the lead agency for the Duwamish ITS Phase 3
Project; and
WHEREAS, the City of Kent is the lead agency for the South 228
th
Street Grade
Separation Projects;
NOW, THEREFORE, BE IT RESOLVED by the Port Commission of Seattle that:
1. The Chief Executive Officer of the Port of Seattle is hereby authorized to execute an Agreement
with:
1.1. City of Seattle for construction and deployment of components of Duwamish ITS Phase 3 in
substantially the form attached to this Resolution as Attachment “1.

2. City of Kent for construction of the South 228
th
Street Grade Separations in substantially the form
attached to this Resolution as Attachment “2.
3. Staff is authorized to take all necessary actions to fulfill the terms of the Agreement including
contribution of:
3.1. $500,000 plus staff and consultant resources toward Duwamish ITS Phase 3 Project
construction in Seattle; and
3.2. $1,190,000 plus staff and consultant resources toward South 228
th
Grade Separations Project
construction in Kent.
4. Copies of the final executed Agreements shall be attached to this resolution as Attachments “3
and “4” and by this reference incorporated herein.
ADOPTED by the Port of Seattle at a regular meeting thereof, held on this ____ day of
__________, 2009, and duly authenticated in open session by the signatures of the Commissioners
voting in favor thereof and the seal of the Commission.
